Entropic Privacy Policy

Entropic, LLC ("Entropic", "we", "us", or "our") is committed to protecting your privacy and ensuring you have a positive experience when using our Products and Services, which include our website, downloadable software, mobile applications, technical support, communications, and other services provided by us and on which a link to this Privacy Policy is displayed (collectively, "Products and Services"). This Privacy Policy describes the information that we gather on or through our Products and Services, how we use and disclose such information, and the measures we take to protect such information. By visiting our website, or by purchasing or using our Products and Services, you are consenting to the information collection and use practices described in this Privacy Policy.


A. Entropic's collection of your personal information

Entropic collects personal information from your use of our website, and information you provide to us directly.


For example:


  • When you place orders on our website or use or purchase our Products and Services;

  • When you download free evaluation software or upgrades;

  • When you register as a user;

  • When you contact Entropic through the Contact Us link on our website;

  • When you participate in a marketing campaign, a public online forum, or referral promotions;

  • When you request a quote or technical support, including submitting a diagnostic log file;

  • When you cause information or data to be sent to Entropic by using our Products and Services;

  • When you participate in the "Owl Cognition Network" program, available in select Products and Services;

  • When you subscribe to Entropic newsletters, product updates or technical alerts;

  • When you enter a contest, giveaway, promotion or special offer;

  • When you provide us with feedback or comments; and

  • When you use our social media outlets.

Entropic may collect the following personally identifiable information about you: your name, company name, billing and shipping information, email address, phone number, credit card or payment information, other relevant information about you and your systems. We use your credit card or payment information only for the purpose of processing your purchase order.


When requesting technical support, Entropic may collect the following personally identifiable information about you: your name, company name, email address, phone number, device log files, and other relevant information about you and your systems. We use this information only for the purpose of resolving the issue you are having with our Products and Services.


For products and services that participate in the "Owl Cognition Network" program, Entropic may collect the following potentially personally identifiable information about you: photos of, and text comments about devices that you choose to submit as a sample, a list of known device identifiers of devices that look similar to the device you are checking, and a pseudonymous customer device identifier.


When submitting samples of hardware devices, which can include photos and text comments, you should avoid capturing, or including any information that can personally identify you, such as pictures of faces, signs, text, and other identifying objects. We use this device sample information only to improve the privacy protection provided by our products and services.


To disable or modify participation in the "Owl Cognition Network" program, select the "Owl Cognition Network" menu option under Preferences.


We will retain personal information we process on behalf of our users for as long as needed to provide our Products and Services. Entropic will retain this personal information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.


B. Entropic's use of your personal information

Entropic collects your personal information necessary to:

  • Provide, maintain, deliver, support and improve its products, services and user experiences;

  • Develop new Products and Services;

  • Provide, maintain, deliver, support and improve the privacy protection (threat intelligence) of our products, services, and user experiences;

  • Send you technical notices and support and administrative messages;

  • Communicate with you about products, services, promotions, events and other news and information we think will be of interest to you;

  • Monitor and analyze trends, usage, user preferences, and activities in connection with our Products and Services;

  • Keep internal records for legal, regulatory, compliance, or auditing requirements; and

  • Complete an order, payment, transaction, or prize award.


C. Communication preferences

Entropic gives you the choice of receiving a variety of information that complements our Products and Services. You can manage your communication preferences and unsubscribe in one of the following ways: (A) Entropic promotional emails include instructions on how you can unsubscribe from future promotional emails; or (B) sending an email to opt_out@scentropic.com (please include your name, email address and specific relevant information about the material that you no longer wish to receive).


D. Sharing your personal information

We may share your personal information with our affiliated companies, resellers, distributors or partners in order to provide the high quality, localized services, accommodate your requests, and provide you with customer support. Entropic may engage service providers to provide certain services, such as providing technical support, handling order processing or shipping products, conduct user research or satisfaction surveys.

For example, if you choose to purchase a license to an Entropic product on our website, you will be directed to the website of one of Entropic's e-commerce resellers, such as Digital River, in order to purchase the license. Entropic and the pertinent e-commerce reseller will need to share some of your personal information. Entropic requires that all contractors keep personal information of our users secure and confidential and that they do not share such personal information with others or use your personal information for their own marketing purposes.

It may be necessary by law, legal process, litigation and/or requests from public and governmental authorities within or outside your country of residence for Entropic to disclose your personal information. We may also disclose information about you if we determine in good faith that for purposes of national security, law enforcement or other issues of public importance, disclosure is necessary or appropriate.

Entropic may also disclose information if we determine that disclosure is necessary to enforce our terms and conditions or protect our products or users.

In the event that Entropic is involved in a merger, acquisition, sale, bankruptcy, insolvency, reorganization, receivership, assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, or other change of control, there may be a disclosure of your information to another entity related to such event.

Entropic may disclose aggregated or de-identified information, which cannot be reasonably be used to identify you.


E. Protection and security of personal information

Entropic understands the importance of securing your personal information. Entropic has taken appropriate and commercially acceptable security measures - including administrative, technical and physical measures - to maintain and protect your personal information against loss, theft, misuse, unauthorized access, disclosure, alteration and destruction. Access to your personal information is restricted to authorized personnel only.


F. Use of cookies and other technology

Entropic's website, online services, interactive applications and email messages may use cookies and other technologies such as web beacons. Cookies are small data files that are stored on your device when you visit a website, which enable us to collect information about your device identifiers, web browsers used to access the Services, pages or features viewed, time spent on pages, mobile app performance and links clicked. This information, which does not personally identify you, is used to determine what content to serve to you when you land on our pages and to provide you with the offers of Products and Services that are most relevant to you. The data collected by the cookie expires after 14 days unless you visit our website again. Cookies may also be used to serve you with banner ads if you exit our store without purchasing. These cookies expire automatically within 30 days.

If you do not want Entropic to deploy cookies in your browser, you can set your browser to reject cookies or to notify you when a website tries to put a cookie in your browser software. Rejecting cookies may affect your ability to use of some of our Products and Services.

Entropic also uses "web beacons" (or single pixel or clear GIFs) on our website to analyze traffic patterns such as the frequency of use of particular parts of our website. The data collected helps us learn what information is of most interest to our users and what our users would most like to see. You can opt-out of this analysis by disabling JavaScript on your computer but note that if you do so, some of the features on our website will not work. The information collected is generally anonymized and is not used to identify any particular user. Entropic has no access or control of any third party tracking technologies.

Entropic's website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"), for the purpose of analyzing website usage and Internet traffic. You can opt out of Google Analytics by configuring your browser to disable the use of cookies but we would like to point out that this may prevent you from making full use of this website. You can also stop data (incl. your IP address) created by cookies and associated with your website usage from being sent to Google or processed by Google by downloading and installing the browser plug-in available at the following link http://tools.google.com/dlpage/gaoptout?hl=en


G. Managing your personal information

If you participate in an Entropic discussion forum on our website, or on our social media channels, you acknowledge and consent that the information you provide there will be made broadly available to the public, and can be read, collected or used by other users of these forums, inside or outside of Entropic. This information can be used to send you unsolicited messages. You are responsible for the personal information you choose to submit in these instances. For example, if you list your name and email address in a forum posting, that information is public. Entropic is not responsible for the personal information or any other information you choose to submit to the public in these forums or social media channels.


H. Collection and use of non-personally identifiable information

Entropic also collects non-personally identifiable information which means data that does not relate to a single, identifiable user. Entropic may collect, use, transfer and disclose non-personally identifiable information for any purpose.

Entropic may collect certain information to better understand user behavior and improve our products, services and advertising. We may also collect information regarding user activities on Entropic's website and from our Products and Services.

This information is aggregated and used to help Entropic provide more useful information to our users, to understand and analyze trends, understand which parts or pages of our website, administer the site, to learn about user behavior on the site and understand which Products and Services are of most interest to our users, to gather demographic information about our user base as a whole and to improve our users' experience. Entropic collects this information through cookies or web beacons.

Entropic also collects log files of traffic that visit our websites, and treats such information as non-personally identifiable information. These log files may include information such as your Internet Protocol (IP) address, browser information and language, domain name, product id, product version, operating system version, date and time of request.

We use this information to track aggregate traffic patterns throughout our website but such information does not correlate with any personally identifiable information. Entropic may collect and retain for a certain period IP address information of users in order to provide technical support, obtain geo-location information, for subscription and registration purposes and to secure our networks and systems.

However, to the extent that IP addresses or similar identifiers are considered personal information by local law, we also treat these identifiers as personal information in accordance with Sections A-E above. Similarly, to the extent that non-personally identifiable information is combined with personally identifiable information, we treat the combined information as personally identifiable information for purposes of this Privacy Policy.


I. Third-Party websites

Entropic's website contains a number of links to third-party websites, which are operated by Entropic's business partners. Such third-party websites may collect your information pursuant to their own policies and purposes. The information that you provide to those third parties are not processed or controlled by Entropic. You should carefully read the privacy policies on such websites or co-branded websites as they may differ from Entropic's Privacy Policy, especially as information collected on such websites is governed by the pertinent privacy policies.


J. Children

As stated in the Terms of Services, Entropic only provides Products and Services to users aged above 18. Entropic does not knowingly collect personal information from children under the age of 13. If we obtain actual knowledge that we have collected the personal information of a child under the age of 13, Entropic will promptly delete such information.


K. GDPR compliance

Entropic is not acting in the capacity of data controller in terms of the European Union's General Data Protection Regulation (Regulation (EU) 2016/679, hereinafter "GDPR") and does not have the associated responsibilities under the GDPR. Entropic should be considered only as a processor on behalf of its users as to any personal information that is subject to the requirements of the GDPR. Except as provided in this Privacy Policy, Entropic does not independently cause users' personal information to be transferred or otherwise made available to third parties, except to third party subcontractors who may process such data on behalf of Entropic in connection with Entropic's provision of Products and Services to our users.

Entropic is based in the United States. If you choose to use the Products and Services from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you may be transferring your personal information outside of those regions to the United States for storage and processing by our service providers. We will comply with GDPR requirements providing adequate protection for the transfer of personal information from Europe to the U.S. Also, we may transfer your data to the U.S., the EEA, or other countries or regions deemed by the European Commission to provide adequate protection of personal data in connection with storage and processing of data, fulfilling your requests, and operating the Products and Services.

In addition to the ways described in Sections C and F above, which allow you to opt out of certain data collection practices, you have the right to (A) access the data we collect about you; (B) have inaccuracies corrected; (C) have information erased; (D) prevent direct marketing; and (E) prevent automated decision-marking and profiling. L. Changes to the Entropic Privacy Policy

Entropic may change this Privacy Policy from time to time. If we make changes to the Privacy Policy, we will revise the date at the top of the Privacy Policy and, in some cases, we may notify you either by prominently posting a notice of such changes prior to implementing the change or by directly sending you a notification. Your continued use of the Products and Services constitutes your agreement to this Privacy Policy and any future revisions.
